Welcome to Wit (the "App"), operated by Wit Dating ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
To access certain features, you must create an account by providing a valid email address and creating a password, or by using a supported third-party sign-in service (e.g., Apple Sign-In).
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable.

You acknowledge that you use AI-generated suggestions at your own discretion and risk.
The App may offer both free features and premium subscription plans ("Premium"). Premium features, pricing, and availability are described within the App and may change at any time.
Premium subscriptions are billed on a recurring basis (weekly, monthly, or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
Payments are processed by Apple through the App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases. Apple's payment terms apply.
You may cancel your subscription at any time through your device's subscription management settings:
Cancellation takes effect at the end of the current billing period. You will continue to have access to Premium features until the end of your paid period. No refunds will be provided for partial billing periods.
We may change subscription prices at any time. Price changes will take effect at the start of the next billing period following the date of the price change. If you do not agree with a price change, you may cancel your subscription before the change takes effect.
Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.

The App, including its design, features, content, and underlying technology, is owned by Wit Dating and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of the messages and text you submit to the App. By submitting content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the App's services to you. We do not claim ownership of your content.
If you provide us with suggestions, ideas, or feedback about the App, you grant us the right to use such feedback without restriction or compensation to you.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WIT DATING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless Wit Dating and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
YOU AGREE THAT ANY CLAIMS SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the modified Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and Wit Dating regarding your use of the App.
